What is the purpose of this notification?
The California Public Utilities Commission (CPUC) wants to hear from you. In-person and virtual public participation hearings (PPHs) have been scheduled to hear your comments, concerns, and opinions regarding changes to the Commission’s licensing and oversight of video franchisees under the Digital Infrastructure and Video Competition Act of 2006 (DIVCA). Among other items, Senate Bill (SB) 28 (Stats. 2021, Chap. 673) revises DIVCA to require that the Commission adopt customer service requirements for a holder of a state video franchise and to adjudicate customer complaints regarding these services. Your participation by providing comments can help in the development of the new rules.
You can attend the in-person hearings. You can also watch a livestream of the remote hearings. You can state your comments and participate either at the in-person or remote hearing. You can also submit comments by mail or post them on the CPUC’s public comment portal. The CPUC invites you to a Commission webpage maintained by the Public Advisor’s Office about this proceeding and your participation. The remote PPHs may be observed using the lived video broadcast AdminMonitor webcast link or heard on the toll-free telephone number. The AdminMonitor broadcast has English or Spanish captions that can be accessed by clicking the green button below the video screen. To provide public comment, participants should use the toll-free telephone number and participant code noted above. Participants who wish to speak must then press “star one” and record their first and last name when prompted. This will alert the operator who will then queue the speakers one-at-a-time and announce each speaker’s name at the allotted time. When it is time for public comment, the ALJ will make an announcement through the telephone line for those who wish to speak. Public officials wishing to speak at the PPHs should provide the telephone operator with their name, title, and governmental entity.

How does this process work?
This rulemaking is considering changes to DIVCA that require the Commission to adopt customer service requirements for a holder of a state video franchise and to adjudicate customer service complaints regarding these services. The rulemaking is assigned to a CPUC Administrative Law Judge and a Commissioner, who will consider proposals and evidence presented during formal processes, and then issue a proposed decision. Any CPUC Commissioner may sponsor an alternate decision with a different outcome. The proposed decision, and any alternate decisions, will be discussed and voted upon by the CPUC Commissioners at a public CPUC Voting Meeting.
