Additional Terms and Conditions
Internet Service Plan Offerings and Terms 

Mediacom offers wired internet service (“Xtream Internet”) and fixed wireless internet service (“Bolt Internet”) (each, a “Service”) subject to certain limits on use, including that the Service shall be used for residential purposes only and may not be used in ways that violate Mediacom’s Acceptable Use Policy (“AUP”) or these Additional Terms and Conditions. These additional terms and conditions apply only to Mediacom’s mass market services; bulk residential plans and commercial business plans are subject to the terms and conditions of their individual contracts.

These terms and conditions are subject to change. By receiving prior notice of an update to these Additional Terms and Conditions and continuing to use the Service, Customer agrees to the applicable customer agreement and to these Additional Terms and Conditions. Terms capitalized that are not defined below shall have the same meaning as defined in the applicable customer agreement.

Without limitation, Customer’s usage of the Service cannot restrict, inhibit, interfere with or otherwise disrupt or cause disruption to or performance degradation of other users, or impair or threaten to impair the operation of Mediacom’s systems, services or network.

Residential Plan Downstream Usage Allowances.

Certain of our residential Service plans are subject to a monthly data usage allowance for downstream usage (“Downstream Monthly Usage Allowance”). Below is a detailed summary of Mediacom’s Service plan offerings, and the applicable Downstream Monthly Usage Allowance for each available plan. Customers shall be subject to the Downstream Monthly Usage Allowance amount for their Service plan as set forth in the tables below as well as all other terms and conditions of the applicable Customer Agreement and these Additional Terms and Conditions. Service plans, the amount of any Downstream Monthly Usage Allowance, and whether a Downstream Monthly Usage Allowance is associated with any particular Service plan are subject to change at any time in Mediacom’s sole discretion. The Downstream Monthly Usage Allowance does not give Customers or any user a right to any bandwidth use or speed at any particular moment in time and it does not carry-over from month to month. Measurement of the Downstream Monthly Usage Allowance resets on the first day of the monthly billing cycle, regardless of actual usage during the prior monthly billing cycle. Downstream bandwidth usage is measured for each monthly billing cycle, not by calendar month. The amount of downstream bandwidth usage of Customer’s account is the sole responsibility of Customer, whether or not such usage was by Customer or authorized by Customer.

Additional Usage Fee for Downstream Usage

If downstream bandwidth usage of an account exceeds the amount of the applicable Downstream Monthly Usage Allowance, Customer agrees to pay an additional monthly usage fee equal to ten dollars ($10) for each additional whole or partial block of 50 GB of usage (“Additional Usage Fee”). For example, if the Downstream Monthly Usage Allowance is 150 GB and 151 GB are actually used, the Additional Monthly Usage Fee would be $10. If the actual usage was 201 GB, then the Additional Usage Fee would be $20. Additional Usage Fees are not prorated for partial billing cycles. The amount of the Additional Usage Fee does not include any applicable fees and taxes. The amount of the Additional Usage Fee and the amount of usage that triggers that fee are subject to change at any time by Mediacom in its sole discretion. Additional Usage Fees will appear on Customers’ bills on the next billing cycle after the Downstream Monthly Usage Allowance was exceeded. Any waiver of its right to bill, or rescission of any Additional Usage Fees in whole or in part by Mediacom, shall not constitute a future waiver of its right to charge, and Customer’s obligation to pay, future Additional Usage Fees. Although Mediacom will attempt in the ordinary course of business to inform Customer prior to exceeding a Downstream Monthly Usage Allowance, whether or not such attempt is successful shall not affect Customer’s obligation to pay any Additional Usage Fees. Customers can check their monthly bandwidth usage at any time by logging into their Mediacom Account.

Potential Reduced Speeds for Downstream Usage

Certain Internet Service plans, as indicated below, are subject to potential reduced speeds for downstream usage. For those plans, if a customer’s downstream bandwidth usage exceeds 17 TB during a monthly billing cycle, the customer’s download speed may be reduced by no more than 50% for the remainder of the customer’s billing month. The failure of Mediacom to enforce its right to reduce download speed, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

Potential Reduced Speeds for Upstream Usage

Certain Internet Service plans, as indicated below, are subject to potential reduced speeds for downstream usage. For those plans, if a customer’s upstream bandwidth usage exceeds 1 TB upload usage during a monthly billing cycle, the customer’s upload speed may be reduced by 50% for the remainder of the customer’s billing month. Any waiver of its right to reduce upload speed by Mediacom shall not constitute a future waiver of such right.

Bolt Internet+ is only available in locations for which Mediacom receives Rural Digital Opportunity Fund support from the FCC. Customers in these locations will be offered download/upload speeds of 100Mbps/20Mbps and a monthly usage allowance of 2,000 GB consistent with FCC requirements.

Grandfathered Service Plans

Grandfathered Internet Service plans are plans that are no longer available for new subscriptions, but that Mediacom continues to support. Customers who subscribed to a grandfathered Internet Service plan prior to the date they were discontinued will continue to receive the Service with the download and upload speeds and usage allowances listed below until the customer chooses to change service, or until Mediacom elects to no longer support it (in which case Mediacom will provide prior written notice). Customers in grandfathered Internet Service plans remain subject to the Additional Usage Fee and potential reduced speeds that existed at the time the customer subscribed to the Service, unless otherwise provided notice of a change.
